Breaking news: U.S. House of Representatives Introduces Resolution Citing Human Rights Concerns in Nnamdi Kanu Case
The United States House of Representatives has introduced a resolution calling on the Government of Nigeria to ensure that all legal proceedings involving Mazi Nnamdi Kanu are conducted in line with Nigeria’s constitutional obligations and international human rights commitments.
The resolution, submitted by Rep. James and dated April 9, 2026, highlights growing concerns about the treatment of Kanu, the leader of the Indigenous People of Biafra (IPOB), who has remained in custody following his controversial transfer from Kenya to Nigeria in June 2021 and was later convicted and imprisoned in November 2025.
On November 20, 2025, a Federal High Court in Abuja, presided over by Justice James Omotosho, found Kanu guilty on terrorism-related charges, including inciting violence and unlawful broadcasts. He was sentenced to life imprisonment for several counts, while also receiving additional concurrent sentences of 20 years and 5 years for other charges. The court declined to impose the death penalty, noting it is increasingly discouraged globally.
The resolution raises concerns about the circumstances surrounding Kanu’s arrest in Nairobi, Kenya, in June 2021 and his subsequent transfer to Nigeria. It notes that legal observers and international bodies have questioned whether the process complied with international law.
It also references a 2022 opinion by the United Nations Working Group on Arbitrary Detention, which concluded that Kanu’s detention violated international human rights obligations and called for his release and compensation.
Further concerns highlighted
include rulings by Kenyan courts regarding the legality of his transfer, as well as allegations from human rights groups about due process violations, restricted access to legal counsel, and poor detention conditions.
The resolution warns that prolonged detention without adequate medical care raises serious humanitarian concerns.
In its concluding section, the U.S. House of Representatives makes several recommendations. It urges the Nigerian government to ensure that all legal proceedings involving Kanu are conducted in full accordance with constitutional and international human rights standards. It also encourages Nigeria to consider the findings of the United Nations Working Group on Arbitrary Detention.
Additionally, it calls for consistent access to legal counsel, adequate medical care, and humane detention conditions for Kanu. It further encourages the U.S. Secretary of State to engage Nigerian authorities on issues relating to due process and fundamental rights.
Finally, the resolution reaffirms the United States’ commitment to human rights, freedom of expression, and the rule of law globally.
